#2024Polls: Court dismisses NDC’s injunction against EC’s re-collation of parliamentary results
An Accra High Court has dismissed an application filed by the National Democratic Congress (NDC) seeking to place an injunction on the Electoral Commission (EC) from re-collating parliamentary results in nine disputed constituencies.
The court ruled that it could not endorse declarations made under duress, emphasizing that such actions undermine the credibility of the electoral process.
The dispute arose after the EC announced its decision not to uphold results from nine constituencies due to disruptions and irregularities during the collation process.
The affected constituencies include:
Ablekuma North Okaikwei Central Tema Central Dome Kwabenya Nsawam Adoagyiri Techiman South
The EC stated that the disruptions were caused by supporters of political parties who stormed collation centres, damaged property, and intimidated its staff.
In some cases, the incidents led to vandalism, including the destruction of computers used for electronic collation.
In its decision, the High Court stressed that endorsing results declared under duress would compromise the integrity of Ghana’s electoral process.
The ruling clears the path for the EC to proceed with re-collating the results in the disputed constituencies.
The EC has welcomed the court’s decision, affirming its commitment to conducting the re-collation process transparently and fairly.
The commission assured the public that the exercise would reflect the will of the people.
The NDC has expressed disappointment with the ruling, accusing the EC of bias and alleging an attempt to manipulate the electoral process in favour of the New Patriotic Party (NPP).
The party has vowed to explore all available legal avenues to challenge the decision.
