Court dismisses charges against NDC’s Ashie-Moore over procedural errors
In a landmark decision applauded by many within the legal and political spheres, the Accra Circuit Court ‘8’ has dismissed a criminal case brought against Emmanuel Nii Ashie-Moore, the Greater Accra Regional Chairman of the National Democratic Congress (NDC), along with one other accused.
Presiding Judge His Honour Jojo Amoah Hagan ruled that the charge sheet submitted by the police was fundamentally flawed and legally untenable.
He noted that the charges were duplicitous and that the prosecution lacked the authority to proceed with the matter, as the alleged amount involved over US$1.6 million exceeded the statutory threshold of GH¢500,000.
In such cases, prior approval from the Attorney-General is mandatory, which was absent in this instance.
The court also found that the defendants had not been properly served, stressing that criminal charges must be directly communicated to the accused.
Based on these procedural and jurisdictional failings, the case was struck out, and both individuals were discharged.
Following the ruling, sources within the NDC described the case as a deliberate smear campaign engineered by political rivals seeking to undermine Ashie-Moore’s rising influence.
“This was nothing short of a targeted attempt to damage the Chairman’s impeccable track record,” an NDC official close to the matter stated.
“But justice has triumphed. Ashie-Moore's legacy and credibility remain intact.”
Ashie-Moore’s tenure as Regional Chairman has been widely commended, particularly after the NDC secured a historic 29 parliamentary seats in the Greater Accra Region during the 2024 general elections, a record-breaking feat under his leadership.
Supporters gathered outside the courthouse in a show of solidarity, praising Hon. Ashie-Moore’s resilience and steadfast leadership amid the legal ordeal.
In his first public remarks following the judgment, Ashie-Moore expressed gratitude and reiterated his dedication to the NDC and its grassroots.
“I have unwavering faith in the rule of law and divine justice.
“This is a collective victory for everyone who believes in truth and integrity.
My focus remains on strengthening our party, investing in our youth, and positioning the NDC for a decisive win in the next elections,” he affirmed.
Analysts say the court's ruling not only exonerates Ashie-Moore but also sends a strong message about the independence of the judiciary and the importance of due process.
Many within the NDC see the verdict as a catalyst for renewed unity and momentum in the lead-up to the 2028 elections.
As political tensions simmer ahead of the next electoral cycle, this decision may well signal a shift towards more issue-based political engagement with Ashie-Moore firmly back in the driver’s seat.
