Speaker returns SC ruling processes, citing Constitutional requirements

The Speaker of Parliament, Rt. Hon. Alban Sumana Kingsford Bagbin, has instructed the Deputy Clerk of Parliament, Ebenezer Ahumah Djietror, to return the Supreme Court’s ruling regarding the declaration of four parliamentary seats as vacant.
In a letter dated October 18, addressed to the Registrar of the Supreme Court, the Speaker cited constitutional requirements for this action.
The letter indicates that the processes were left at the Legal Services Office of the Parliamentary Service by three bailiffs from the Supreme Court on Wednesday, October 16, 2024.
It also notes that attempts were made to serve these processes on Tuesday, October 15, 2024.
Speaker Bagbin contended that the attempted service contravenes Article 117 of the 1992 Constitution.
He referenced a circular issued by Her Ladyship Cyra Pamela CA Korangten, the Judicial Secretary, which was copied to the Honourable Lady Chief Justice.
This circular, identified by reference number SCR9, addressed the "Enforcement of Articles 117 and 118 of the Constitution – Immunity from Service of Process and Arrest" and was dated July 12, 2024.
The Speaker’s letter concluded by reaffirming the importance of adhering to these constitutional guidelines.
