Supreme Court puts giant pause button on GN Bank’s reopening plans

The Supreme Court of Ghana has suspended a lower court's order that directed the central bank to restore the operating licence of GN Savings and Loans Limited.

This decision means the Bank of Ghana (BoG) does not have to return the company's licence while the Supreme Court reviews the case. GN Savings and Loans will remain closed for the time being.

Why the Licence Was Put on Hold

The legal dispute began when the Bank of Ghana revoked the operating licence of GN Savings and Loans as part of a national exercise to clean up the financial sector.

The owners of GN Savings challenged this decision in court:

- The Court of Appeal's Ruling: The Court of Appeal previously ruled in favour of GN Savings, ordering the central bank to restore its licence.

- The Bank of Ghana's Appeal: The central bank disagreed with this decision and appealed to the Supreme Court, asking for the order to be put on hold (stay of execution) while the appeal is heard.

What the Supreme Court's Decision Means

By granting the stay of execution, the Supreme Court has temporarily frozen the Court of Appeal's order.

The current situation will not change until the Supreme Court holds a full hearing. The highest court will ultimately decide whether the BoG acted within the law when it revoked the licence, and whether the Court of Appeal was correct in ordering its return.
